Per Curiam. A. C. Moyers (Moyers), an Alabama cattleman, and Bourbon Livestock Center (BLC), a Kentucky livestock auction house, engaged in numerous transactions. Moyers presented two claims against BLC in the District Court: 1) that BLC owes Moyers $143,648.93, plus interest, for cattle which BLC sold on Moyers behalf, and that BLC failed to deliver to Moyers certain cattle which he had purchased, and 2) that BLC maliciously prosecuted a criminal case against Moyers.
